Welcome to Rainmaker Website Systems. By accessing this website, booking a call or using any Rainmaker systems, software or services, you agree to these Terms of Service. If you do not agree, do not use the website or services.
1. What Rainmaker Provides
Rainmaker installs and provides access to business-growth systems for service-based businesses. Depending on the selected plan, services may include website hosting and functionality, lead capture and follow-up automation, review request and management tools, messaging, email and SMS automation, scheduling, customer communication, reporting and dashboard access.
Rainmaker provides systems—not guaranteed outcomes. Results depend on the customer's business, follow-up, pricing, service quality, market and other conditions outside Rainmaker's control.
2. No Guarantees or Promises
Rainmaker does not guarantee a specific number of leads, increased revenue, search-engine rankings, review volume, star ratings or conversion rates. The systems are designed to improve efficiency and opportunity. Customer implementation and market response will vary.
3. Customer Responsibilities
By using the services, the customer agrees to:
- Provide accurate and current business information.
- Contact only customers and leads the business is legally permitted to contact.
- Follow all applicable marketing, SMS, email and data-privacy laws.
- Remain responsible for communications sent through the customer account.
- Review messages, campaigns, information and automations configured for the business.
4. Messaging, SMS & Email Compliance
Customers using SMS, email or automated messaging confirm that they have the required permission to contact recipients and agree to comply with the TCPA, CAN-SPAM Act and other applicable laws. Message delivery is not guaranteed. Rainmaker is not responsible for fines, penalties or legal issues caused by improper use of communication tools.
5. Payments, Billing & Subscriptions
Fees are billed as agreed at signup. Subscriptions are billed monthly unless stated otherwise. Payments are nonrefundable unless Rainmaker agrees otherwise in writing. Failure to pay may result in suspension or termination of service. Customers may cancel according to the terms of their selected plan. Access may end at the close of the paid billing period.
6. Website & System Changes
Rainmaker may update, improve or modify system features; change layouts, integrations or workflows; and replace or remove features when required by vendors or technology partners. Rainmaker will not intentionally remove core functionality without reasonable notice when practical.
7. Third-Party Services
Rainmaker systems may connect with email providers, SMS carriers, payment processors, hosting platforms and other third-party services. Rainmaker is not responsible for outages, delays, policy changes or failures caused by third-party providers.
8. Intellectual Property
Rainmaker's system components, workflows, templates, automations, designs and materials remain Rainmaker's intellectual property unless a written agreement states otherwise. They may not be copied, resold, reverse-engineered or distributed without written permission.
9. Suspension or Termination
Rainmaker may suspend or terminate access if a customer violates these terms, uses the system for illegal or unethical purposes, abuses communication systems, sends spam or creates legal or operational risk. No refund is owed for a suspension or termination caused by a customer violation.
10. Limitation of Liability
To the fullest extent permitted by law, Rainmaker is not liable for lost revenue or profit, missed leads or messages, downtime, system interruptions or data loss beyond reasonable control. Rainmaker's total liability, if any, will not exceed the amount paid by the customer during the previous 30 days.
11. Privacy
Use of the website and systems is also governed by the Privacy Policy below.
12. Changes to These Terms
Rainmaker may update these terms. Continued use of the website or services after an update means the customer accepts the revised terms.
13. Governing Law
These terms are governed by the laws of the State of Maryland without regard to conflict-of-law principles.

Customer & Lead Data Processed for Clients
When a client uses Rainmaker systems to manage customers or leads, Rainmaker may process names, phone numbers, email addresses, message history, appointment information and interaction data on the client's behalf. This data belongs to the client.

Rainmaker may collect IP address, browser type, device information, pages visited, cookies and similar technical data to understand site usage and improve performance.

Clients using automated communications confirm that they have permission to contact recipients and agree to comply with the TCPA, CAN-SPAM Act and applicable laws. Delivery is not guaranteed. Rainmaker is not responsible for misuse of communication tools or violations caused by improper client use.
5. Cookies & Tracking Technologies
Rainmaker may use cookies and similar technology to improve site performance, understand visitor behavior and measure traffic or conversions. You may disable cookies in your browser, although some features may not function correctly.
6. Sharing of Information
Information may be shared with trusted providers that help operate Rainmaker systems, including hosting providers, payment processors, email and SMS delivery services and analytics platforms. Providers receive only the access needed to perform their services and are expected to protect the information they process. Rainmaker does not sell or rent personal data.
